Sale Terms

The size and weight of all items are approximate. All prices and related fees are in United States dollars. Prices shown on the Site are subject to confirmation and may be changed without notice, at our discretion. Additional fees related to delivery or otherwise are shown on our website and on your order.

ATTITUDE reserves the right to correct any pricing errors displayed on the Site. Prices shown on the Site may differ from prices displayed in stores or in the various distribution networks for our products. ATTITUDE is not liable to you or to any third party for any change in the price of a product.

Payment Method 

ATTITUDE accepts the following payment methods for purchases made on its website:

Only credit card payments are accepted for subscriptions.

Purchase

ATTITUDE may modify, refuse or cancel any order or purchase, in particular due to a system error, fraud, or any other cause beyond its control. In the event of a modification, refusal or cancellation of an order or purchase, ATTITUDE undertakes to notify you as soon as possible.

We also reserve the right to cancel or limit (per person, per household or per order) the quantity of products you may order or purchase, at our sole discretion, if we have reasonable grounds to believe that the transaction violates these Terms of Use. For example, where such orders are placed using the same customer account, the same credit card, and/or the same billing and/or shipping address, or where orders appear to be placed by merchants, resellers or distributors.

Product

The availability of products offered on the Site, as well as the descriptions of these products, may vary depending on location and time, and ATTITUDE makes no warranty in this regard.

We reserve the right to limit the quantities of any products we offer. All product descriptions may be changed without notice, at our sole discretion. We reserve the right to discontinue or stop selling any product at any time. Any offer for a product made on this Site is void where prohibited.

We do not warrant that the quality of any products, services, information or other materials purchased or obtained by you through the Site will meet your expectations, to the extent permitted by applicable law.

Out-of-Stock Items

Displaying Unavailability

When a product is temporarily out of stock, the notice “Unavailable” is clearly displayed on its product page. This notice lets customers know that the item is not currently available for purchase.

Notifications

For certain products, you have the option to sign up to receive an email notification when the product becomes available again. This option is accessible directly on the relevant product page.

Subscription Orders

As part of subscriptions, if a product is temporarily out of stock, it will not be shipped and you will not be charged for that item. We will notify you if applicable.

Subscription

The ATTITUDE subscription program allows you to automatically receive your favourite products at the delivery frequency of your choice (for example, every month), while benefiting from a 10% discount on every order. This service is designed to offer you a convenient, flexible and advantageous shopping experience.

Acceptance of Terms

By subscribing, you represent that you have the legal capacity to enter into a contract.

In addition, by subscribing to our subscription program, you accept these terms, as well as our Terms of Use, which include the provisions relating to return and delivery, and any other applicable policy available on our website. We encourage you to read them carefully.

Terms

Frequency and Customization

You may choose the delivery frequency that suits you, between 2, 3 and 6 months. It is possible to modify the frequency, products or quantities of your subscription at any time through your customer account.

Payment

Payment is automatically charged to the credit card on file in your account at each delivery cycle, and an invoice is sent to you by email.

Only valid credit cards are accepted for orders placed under a subscription.

In the event of a payment failure, you will receive an email inviting you to update your payment information.

10% Discount

A 10% discount is automatically applied to each order placed under the subscription.

This discount cannot be combined with other promotions or discount codes, unless otherwise indicated.

Automatic Renewal

Your subscription is entered into for an indefinite period, unless otherwise indicated at the time of purchase, and automatically renews according to the delivery frequency chosen.

Modifications and Termination

You may modify, suspend, cancel or terminate your subscription at any time at no cost, directly from your customer account.

Any modification, suspension, cancellation or termination must be made at least 24 hours before the scheduled date of the next shipment to avoid being charged.

Product Availability

Products are offered while supplies last.

If a product is unavailable at the time of shipment, you will be notified by email and will not be charged for that product.

No product substitution will be made without your prior consent.

Refusal and Limitations

ATTITUDE reserves the right to refuse, suspend or cancel a subscription at its discretion, in particular in the event of suspected fraud or non-compliance with these terms. Where applicable, ATTITUDE undertakes to notify you as soon as possible.

Limitations may apply to the quantities ordered for certain products.

Assignment

You may not assign your rights and obligations under the subscription without ATTITUDE’s prior written consent. ATTITUDE may assign its rights and obligations at any time, subject to notifying you.

 

Loyalty Program

1. Description

The ATTITUDE Rewards Program is designed to thank our loyal customers by offering them points for every purchase made on our site. These points can be redeemed for discounts on future purchases, offering an advantageous and personalized shopping experience.

2. Eligibility Criteria

Any person aged 18 or older, residing in United States, and holding an active customer account on our site is eligible for the Rewards Program.

3. Enrollment

Enrollment in the Rewards Program is automatic upon creating a customer account on our site. No additional registration is required.

4. Updating Personal Information

It is the member’s responsibility to keep their personal information up to date in their customer account, including their email address, in order to receive communications relating to the Rewards Program.

5. Membership Levels and Tiers

6. Annual Review of Tiers/Points

Membership levels are reviewed annually based on purchases made during the previous year (365 days). Accumulated points may also be subject to expiry after a specified period, in accordance with the terms in effect.

7. Accumulation of Points

Members accumulate points for every dollar spent on our site, excluding taxes, shipping fees and banking fees, if applicable.

Additional points may be awarded during special promotions or particular events.

8. Redeeming Points

Accumulated points can be redeemed for discounts on future purchases, according to the applicable scale (for example, 100 points = $5 discount).

Points cannot be redeemed for cash and are non-transferable.

9. Benefits and Rewards

In addition to discounts, members may enjoy exclusive benefits such as special offers, early access to new products, or member-only events.

10. Modification, Termination and Suspension of the Rewards Program

ATTITUDE reserves the right to modify, suspend or terminate the terms and the Rewards Program, in whole or in part, at any time, including with respect to the description of the program, eligibility criteria, enrollment, updating of personal information, membership tier levels, annual review of tiers and points, accumulation and redemption of points, and benefits and rewards. Members will be informed of any significant change through the contact information provided in their account or via a notice posted on the website.

12. Newsletter, Offers and Personalized Communications

If you have consented to receive electronic communications from us by joining the Rewards Program, you may receive electronic communications from ATTITUDE, including newsletters, promotional offers and information about rewards. Members may unsubscribe at any time by following the instructions provided in those communications.

13. Indemnification and Limitation of Liability

ATTITUDE shall not be held liable for losses or damages resulting from the use of, or inability to use, the Rewards Program, except as provided by applicable law.

Referral Program

1. Program Description

The ATTITUDE Referral Program allows you to recommend our products to your friends. By sharing a referral link, the referrer gives the referred person a $20 discount on their first order of $70 or more. In return, the referrer also receives a $20 discount when the referred person makes a purchase.

2. Eligibility

The program is open to any person residing in United States.

It is not necessary to create an account to refer someone or to be referred.

The referred person must place their first order to be eligible for the discount.

3. How Referrals Work

The referrer shares their referral link, available on the “Refer your friends” page, which will be sent by email to the referred person.  https://attitudeliving.com/refer-a-friend

The referred person uses this link to place their first order of $70 or more (before taxes, discounts and shipping charges).

·         Once the referred person’s order is confirmed, the referrer receives an email containing their $20 reward code.

4. Terms and Exclusions

·         The $20 discount for the referred person is valid for 6 months from the date of receipt.

·         The referrer will not receive a reward if the referred person spends less than $70 or does not use the referral link.

·         Self-referral is strictly prohibited.

·         Orders placed by persons residing at the same address as the referrer may be excluded from the program.

5. Personal Data

ATTITUDE collects and processes participants’ personal data in accordance with its Privacy Policy. Information collected as part of the program is used to manage referrals and send the corresponding rewards. Please see our Privacy Policy for more information.

6. Modification of the Program

ATTITUDE reserves the right to modify, suspend or end the Referral Program at any time, including with respect to the description of the program, eligibility, how it works, terms and exclusions, and personal data. Participants will be informed of any significant change through the contact information provided in their account or when they register for the program.

 

Offers and Promotions

This Site may, from time to time, feature special offers or promotions. Promotions may not be combined with any other offer, promotion, bonus or coupon and are valid only for online orders placed through the Site. In addition, there is a limit of one (1) promotion per order. Promotions and discounts on certain selected products are valid while supplies last or until the promotion’s end date. Promotions are valid in United States only.

ATTITUDE may modify, refuse or cancel any promotion, in particular due to a system error, fraud, or any other cause beyond its control.

Delivery

ATTITUDE will make its best commercial efforts to deliver ordered products to you as quickly as possible and within the timeframes indicated on our website, at the following link. These timeframes are provided on an approximate basis. Delays may occur due to exceptional circumstances or periods of high demand. All products are delivered by a third party, and delivery is governed by their shipping agreements and is beyond our control.

1. Delivery Methods and Fees

Orders are shipped through third-party delivery partners. Delivery fees are calculated at checkout and may vary depending on the order amount and destination. For details on delivery fees, please see our website. Promotions, such as free shipping on orders exceeding a certain amount, may be offered from time to time.

2. Order Tracking

Once your order has shipped, you will receive a confirmation email containing a tracking number. This number will allow you to track the status of your delivery through the relevant carrier’s website.

3. Delivery Issues

If you notice a problem with your order upon receipt (missing, damaged or incorrect item), please contact us as soon as possible. Photos of the item in question and of the packaging may be requested to help process your request. We will work with our delivery partners to resolve the issue.

4. Damage and Issues With Your Order

Please inspect your order upon receipt and contact us immediately if the item is defective, damaged or missing, or if you receive the wrong item. Photos of the damaged box, the shipping label and/or the damaged products are required to process your request. A claim will be filed with our delivery partners by one of our customer service representatives. Once our team and the carrier have received all the required information (photos, details, etc.), we will be able to assess the situation and offer compensation for any damaged item. Please note that after a period of 30 days (from the shipping date), we will unfortunately be unable to process your request.

If you have allergies, please be sure to check the ingredients carefully before placing your order. In the event of an allergic reaction, you will be asked to provide us with the lot numbers found on the packaging of the product(s) concerned. We will be able to process your request, an investigation will be initiated, and we will then be able to assess the situation and offer compensation.

5. Liability

ATTITUDE is not liable for any losses, costs, damages, charges or expenses arising from a problem attributable to third-party carriers. We nevertheless undertake to assist you in resolving any issue relating to the delivery of your order.

ATTITUDE shall not be held liable for delays or delivery failures due to circumstances beyond its control, such as force majeure events. Our liability is limited to the amount of the order in question.

 

Return or Exchange

1. General

Products purchased on our website are final sale. For reasons of hygiene, health and safety, as well as to reduce our environmental footprint by reducing additional packaging and transportation, we do not accept returns or exchanges. Please also note that we do not offer compensation for a product or delivery dissatisfaction.

2. Online and In-Store Purchases

Online orders cannot be returned in-store. If your product was purchased at one of our ATTITUDE stores, please return the product to the store.

If your product was purchased on our website or at one of our points of sale, please contact us.

3. Purchases From a Retailer (Amazon, Retail Stores)

If your purchase was made through a retailer, please contact them directly for any return or refund request.

 

Quality Complaints and Adverse Reactions

If you have allergies, please be sure to check the ingredients carefully before placing your order. In the event of an adverse reaction or quality complaint, you will be asked to provide us with the lot numbers found on the packaging of the product(s) concerned. We will be able to process your request, an investigation will be initiated, and we will then be able to assess the situation and offer compensation.

 

Order Cancellation

Sales and orders made on the Site are final. You may not cancel or modify an order that has already been placed, except for reasons specifically provided for by law. However, ATTITUDE may, at its discretion, agree to cancel an order that has not yet been prepared. For any questions in this regard, you may contact us.

 

Gift Cards

1. Nature and Receipt of Gift Cards

ATTITUDE gift cards are electronic. After purchase, an email containing a discount code will be sent to you. You may then forward that email to the recipient of your choice.

2. Use          

To use a gift card, enter the card code in the “gift card or promo code” field at checkout on our website. If your order total exceeds the value of the gift card, you will need to pay the difference. If the total is less, the unused balance may be applied to a future purchase.

3. Restrictions     

·         Gift cards are non-refundable and cannot be exchanged for cash.

·         They are valid only for purchases made on our website and cannot be used in a physical store.           

·         Gift cards have no expiry date.

·         Damaged or altered gift cards will not be accepted.

·         Gift cards have no cash value, except where required by law.

·         Sales of ATTITUDE gift cards are final and cannot be refunded or exchanged.

4. Loss, Theft or Unauthorized Use 

ATTITUDE is not responsible for lost, stolen or unauthorized use of gift cards. Please treat your gift card like cash.

5. Balance

To check the balance of your gift card, please contact our customer service.

6. Returns and Refunds

In the event of a refund for an order paid with a gift card, a new gift card will be issued in the amount of the applicable refund.

7. Acceptance of Terms

Use of a gift card constitutes acceptance of these terms.

 

Contests

This Site may, from time to time, feature contests in which you can participate through the Site, or a social media platform administered by ATTITUDE. Each contest is governed by its own contest rules, which you must read and accept before participating, as well as by applicable laws.

Term and Termination

ATTITUDE may, however, at its sole discretion, stop providing you with access to the Site, deactivate your account or password, or suspend or terminate your right to use your account or any service or tool linked thereto, with reasonable notice, including in the event of non-compliance with these Terms of Use.

However, in the event of fraud, a security breach, an attempt to circumvent our systems, or any other unlawful activity, ATTITUDE will immediately terminate your access, without notice.

Deactivation, suspension or termination of your right to use your account, or the discontinuation of access to the website, does not release you from any obligations under these Terms of Use that arose prior to the date of deactivation, suspension or termination, including payment of any amounts owed.

Upon termination of this agreement, for any reason whatsoever, ATTITUDE will stop providing you with access to the Site, and you agree to stop using it.

Force Majeure

If ATTITUDE’s performance of any of its obligations hereunder, or as set out in an order confirmation, is delayed due to force majeure or any other reason beyond ATTITUDE’s control (including any total or partial disruption or strike of postal services, means of transportation and/or communications, among others), the performance date will be delayed for the duration of the delay. ATTITUDE shall not be held liable for the non-performance of such obligations in the event of force majeure or any other reason beyond its control.

Entire Agreement, Severability and Waiver

These Terms of Use constitute the sole and entire agreement between you and ATTITUDE and supersede any other prior or conflicting agreement, provision, representation or warranty, whether written or oral, including, without limitation, all prior versions of the Terms of Use. All covenants, representations, warranties and obligations set out in the Terms of Use shall bind and inure to the benefit of you and ATTITUDE, as well as the parties’ respective successors, permitted assigns, legal representatives, heirs and trustees.

The invalidity or unenforceability of any provision of the Terms of Use, or its inapplicability to any person or circumstance, for any reason whatsoever, shall not affect the validity of the other provisions of the Terms of Use. Any ambiguity in the interpretation of these Terms of Use shall not be construed against the drafter.

The failure to enforce any provision of these Terms of Use does not constitute a waiver of the right to enforce that provision, or any other provision hereof, in the future.

 

Governing Law

These Terms of Use, as well as any access to or use of this Site, are governed by the laws and regulations applicable in the province of Québec, as well as those in effect in Canada and in your province of residence. In cases where international laws may apply, or in the event of a conflict with other applicable laws in certain jurisdictions, the matter will be governed by the applicable laws. The United Nations Convention on Contracts for the International Sale of Goods shall not apply at any time to these Terms of Use, nor to the activities contemplated herein.

You expressly agree that any dispute or claim against ATTITUDE, its affiliates, employees or representatives, or relating to the Terms of Use, or relating in any way to the content, your access to or use of the Site (including any order placed on the Site), shall be subject to the exclusive jurisdiction of the courts of the province of Québec.
